About this course

Recruitment in care is the first safeguarding control, and it is regularly the weakest. Schedule 3 of the 2014 regulations sets out what must be obtained before somebody starts, and services breach it routinely under staffing pressure.

This course covers the mandatory checks, the gaps and patterns that matter, right to work, and how to interview so the answer predicts behaviour rather than rewarding fluency.

What you will be able to do

  • List the information required under Schedule 3 before a person starts work
  • Handle a DBS disclosure and a gap in employment history proportionately
  • Check right to work correctly and avoid discriminatory practice
  • Interview using behavioural questions that predict conduct

Questions

Can somebody start before the DBS comes back?

Only in tightly limited circumstances, with a documented risk assessment and appropriate supervision, and never in a role where they would be alone with people using the service. It should be an exception with a written rationale, not the default, and inspectors look at how often it happens.

Can I ask about health at interview?

Generally no. Section 60 of the Equality Act 2010 restricts health related questions before a job offer, with narrow exceptions such as establishing whether a reasonable adjustment is needed for the interview itself, or where a function is intrinsic to the role.
